HC bars disqualified BJP councillor to participate in Shimla MC meeting
Shimla, Jul 13 (UNI) Himachal Pradesh High court on Tuesday barred the disqualified ruling party councillor of Shimla Municipal Corporation – Sanjeev Sood, from participating in the house meeting.
This order was passed by the Division bench of Himachal Pradesh High Court comprising acting Chief Justice Ravi Malimath and Justice Joytsana Rewal while hearing a writ petition filed by Rakesh Kumar here today.
Talking with UNI, the counsel for the petitioner Sanjeev Bhushan said that the court also orders the SMC to submit the records of councillors before the court on the next hearing to show how many meetings he held after his disqualification from the membership since November last year and decision was taken by the MC on his recommendations.
The Court fixed the next date of hearing after the four weeks of issuing this order. The ruling party nominated Councillor Sood was disqualified from his membership by the Director, Urban Development in an order passed on Nov 2, 2020, for encroachment of the government land and submission of false affidavit before the department during his nomination.
The councillor was charged by the petitioner for submission of a false affidavit before the department however the civic body allowed the disqualify councillor to continue to serve as a councillor after his disqualification.
Petitioner said that counsellor has encroached upon the Government land and made an illegal construction of 5.25 square meters.
