Delhi Court Orders Rs 38 Lakh Compensation for Fatal Accident
Car Owner Held Liable for Victim’s Death…
New Delhi: The Patiala House Court has ordered the owner of a car involved in a fatal accident to pay Rs 38 lakh in compensation to the victim’s family. The car’s driver did not possess a valid license, and the court granted the insurance company the right to recover the compensation amount from the car owner.
The Motor Accident Claims Tribunal, led by Presiding Officer Vrinda Kumari, directed that 10% of the total compensation be paid immediately to the family. According to the police report, on November 13, 2018, Bijendra Kashyap was returning from a delivery when his three-wheeler tempo was hit by a car coming from the opposite direction on the Shankar Vihar Flyover. Kashyap tragically lost his life in the accident.
In this nearly five-year-old case, the court emphasized that the victim’s family has the right to financial support and should receive the highest possible compensation. The total amount of Rs 38 lakh was ordered to be paid by adding different components related to the accident.
It was revealed during the investigation that the car involved was part of the Ola taxi service. The car owner’s claim of ignorance regarding the fake license was rejected, but the court granted the insurance company the authority to recover the compensation amount from the car owner.
